{"id":981016,"date":"2025-07-16T07:44:00","date_gmt":"2025-07-16T05:44:00","guid":{"rendered":"https:\/\/tvpg.me\/uncategorized\/otkup-zemljista-i-nova-pravila-otplate-ko-nece-moci-da-legalizuje-objekat\/"},"modified":"2025-07-16T07:44:00","modified_gmt":"2025-07-16T05:44:00","slug":"otkup-zemljista-i-nova-pravila-otplate-ko-nece-moci-da-legalizuje-objekat","status":"publish","type":"post","link":"https:\/\/tvpg.me\/en\/drustvo\/otkup-zemljista-i-nova-pravila-otplate-ko-nece-moci-da-legalizuje-objekat\/","title":{"rendered":"Otkup zemlji\u0161ta i nova pravila otplate; Ko ne\u0107e mo\u0107i da legalizuje objekat"},"content":{"rendered":"<p class=\"wp-block-paragraph\"><br><br><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kupovina u ratama \u2013 do 30 godina otplate<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jedna od klju\u010dnih novina jeste mogu\u0107nost otplate zemlji\u0161ta na rate:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Za objekte osnovnog stanovanja \u2013 maksimalno 360 jednakih mjese\u010dnih rata (30 godina);<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Za ostale objekte \u2013 najvi\u0161e 120 rata (10 godina).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Otplata \u0107e se vr\u0161iti u skladu s ugovorom, uz odgovaraju\u0107e obezbje\u0111enje potra\u017eivanja. Tokom otplate, u katastarskoj evidenciji bi\u0107e upisana predbilje\u017eba, a nakon isplate ukupne cijene zemlji\u0161ta \u2013 izvr\u0161i\u0107e se kona\u010dna uknji\u017eba.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Katastar ima rok: 40 dana za upis i brisanje zabilje\u017ebi<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u010clan 21 predvi\u0111a da je Katastar du\u017ean da u roku od 40 dana od dana prijema rje\u0161enja o legalizaciji:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">upi\u0161e zabilje\u017ebu o rje\u0161enju;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">evidentira izjave vlasnika o odgovornosti i odricanju od prava na \u017ealbu;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">upi\u0161e podatke o na\u010dinu pla\u0107anja naknada.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">U istom roku Katastar mora da izbri\u0161e ranije zabilje\u017ebe o nelegalnoj gradnji, zabrani otu\u0111enja i zabrani obavljanja djelatnosti.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ko ne\u0107e mo\u0107i da legalizuje objekat?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zakon jasno propisuje i slu\u010dajeve u kojima \u0107e zahtjev za legalizaciju biti odbijen (\u010dlan 22):<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ako objekat ne ispunjava osnovne tehni\u010dke uslove;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ako je napravljen od neodgovaraju\u0107ih materijala;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ako je rije\u010d o privremenom objektu;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ako rekonstrukcija nije zavr\u0161ena u predvi\u0111enom roku.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">U tom slu\u010daju, zahtjev \u0107e biti proslije\u0111en inspekciji koja donosi rje\u0161enje o uklanjanju objekta.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Naknade za kori\u0161\u0107enje prostora: I do tri odsto vrijednosti po kvadratnom metru<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Vlasnici bespravnih objekata koji ne pokrenu legalizaciju, kojima je zahtjev odbijen, ili koji ne pokrenu upis u katastar \u2013 pla\u0107a\u0107e godi\u0161nju naknadu za kori\u0161\u0107enje prostora (\u010dlan 26).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Naknada se kre\u0107e:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">od 0,5 odsto do dva odsto prosje\u010dne cijene izgradnje, ako postoji elaborat izvedenog stanja;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">od jedan odsto do tri odsto, ako ne postoji elaborat ili objekat nije upisan u katastar.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Visinu i kriterijume odre\u0111uje lokalna samouprava uz saglasnost Ministarstva, a prihod ide direktno u lokalni bud\u017eet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Zakon uvodi elektronsku evidenciju i nadzor<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lokalne samouprave \u0107e biti obavezne da vode elektronsku evidenciju bespravnih objekata i njihovih vlasnika. Katastar je u obavezi da im, na zahtjev, dostavi sve podatke o objektima bez dozvola i njihove grafi\u010dke prikaze.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Za izradu elaborata premjera postoje\u0107eg stanja anga\u017eova\u0107e se geodetske organizacije izabrane putem javnog tendera, a vlasnici objekata su du\u017eni da im omogu\u0107e pristup.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Uklanjanje objekata \u2013 tek nakon odbijanja legalizacije<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Objekti za koje nije podnijet zahtjev za legalizaciju, ili im je odbijen, bi\u0107e uklonjeni po rje\u0161enju inspektora za za\u0161titu prostora (\u010dlan 31). Me\u0111utim, kada je rije\u010d o osnovnim stambenim objektima, ru\u0161enje mo\u017ee biti sprovedeno tek nakon \u0161to se vlasniku obezbijedi alternativni smje\u0161taj.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Predlo\u017eeni zakon donosi sveobuhvatan okvir za re\u0161avanje problema bespravne gradnje u Crnoj Gori, kroz mehanizme legalizacije, otkupa zemlji\u0161ta i stro\u017eeg nadzora.
